Instructions on the Right of Withdrawal

For consumers in distance contracts for goods, digital services and subscriptions

These Instructions on the Right of Withdrawal apply to consumers within the meaning of section 13 BGB where they have a statutory right of withdrawal in connection with a distance contract. For purchases through the Apple App Store, Google Play or other third-party platforms, the statutory and contractual procedures applicable there may also apply.

A. Instructions on the Right of Withdrawal for Goods

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods. For a single order consisting of several goods delivered separately, the period begins upon receipt of the last item; for goods delivered in several consignments or parts, it begins upon receipt of the last consignment or the last part.

To exercise your right of withdrawal, you must inform us—Ponora International GmbH, Hammfelddamm 4 A, 41460 Neuss, Germany, email: support@ponora.ai—of your decision to withdraw from this contract by an unequivocal statement, for example by letter or email. You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us. Additional costs resulting from your choice of a type of standard delivery other than the least expensive one will not be reimbursed.

We will make the reimbursement without undue delay and no later than fourteen days after the day on which we receive your declaration of withdrawal. We will generally use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; you will not incur any fees as a result of the reimbursement.

For goods, we may refuse reimbursement until we have received the goods back or until you have proven that you have sent back the goods, whichever is the earliest. This does not apply if we have offered to pick up the goods.

You must return or hand over the goods to the return address specified by Ponora without undue delay and, in any event, no later than fourteen days after the day on which you inform us of your withdrawal. The deadline is met if you dispatch the goods before it expires.

You bear the direct cost of returning the goods, provided that we duly informed you of this before the contract was concluded and did not expressly promise to bear those costs. Statutory rights in respect of defects apply independently to defective goods.

You only have to pay for any loss in value of the goods if this loss in value is due to the handling of the goods that was not necessary to check the nature, characteristics and functioning. The absence or opening of the original packaging does not affect the statutory right of withdrawal as such.

B. Instructions on the Right of Withdrawal for Digital Services and Subscriptions

Right of withdrawal

You have the right to withdraw from a paid contract for digital services or a subscription within fourteen days without giving any reason, provided that no statutory exclusion applies and the right of withdrawal has not validly expired early.

The withdrawal period is fourteen days from the date on which the contract is concluded.

To exercise your right of withdrawal, you must inform us—Ponora International GmbH, Hammfelddamm 4 A, 41460 Neuss, Germany, email: support@ponora.ai—of your decision to withdraw from this contract by an unequivocal statement, for example by letter or email. You may use the attached model withdrawal form, but this is not mandatory.

Effects of Withdrawal

If you validly withdraw from this contract, we will reimburse the payments you made under the contract in accordance with the statutory provisions. We will generally use the same means of payment as for the original transaction, unless expressly agreed otherwise and provided that you incur no costs as a result.

If you expressly requested that we begin providing a paid service during the withdrawal period, you may be required, upon withdrawal, to pay us a reasonable amount for the portion of the service provided up to the time of withdrawal, provided that the statutory requirements are met.

Premature start and expiry of the right of withdrawal

For paid services, the right of withdrawal generally expires only when the service has been provided in full, and expires early only if, before performance began, you expressly agreed that Ponora could begin providing the service before the withdrawal period expired and confirmed that you understood that your right of withdrawal would expire once the contract had been performed in full.

For digital content not supplied on a tangible medium, the right of withdrawal may expire when performance of the contract begins if you expressly agreed that performance could begin before the withdrawal period expired, confirmed that you understood you would lose the right of withdrawal, and received the contract confirmation required by law.

A mere login, registration or use of a free service does not automatically lead to the loss of any existing right of withdrawal for a paid contract.

C. Electronic Withdrawal Function

For distance contracts concluded through an online user interface, Ponora provides, pursuant to section 356a BGB, a permanently available, prominently placed and easily accessible electronic withdrawal function. After submitting the withdrawal declaration, you will receive confirmation of receipt without undue delay on a durable medium, stating its content, date and time. Irrespective of this, you may declare withdrawal at any time by an unequivocal declaration by email to support@ponora.ai or by post; statutory periods and rights remain unaffected.

D. Purchases through app stores and third-party platforms

For purchases or subscriptions through the Apple App Store, Google Play or other third-party platforms, the right of withdrawal may be exercised through the relevant platform where this is provided for under the specific contract and payment structure. The information shown when the contract is concluded concerning the contracting party and the applicable withdrawal channel is authoritative. Statutory consumer rights remain unaffected.
